Title IX

What is Title IX?

Title IX is a federal law that prohibits sex based discrimination, including sexual harassment. This federal law defines sexual harassment as any instance of quid pro quo harassment by a school’s employee; any unwelcome conduct that a reasonable person would find so severe, pervasive, and objectively offensive that it denies a person equal educational access; any instance of sexual assault (as defined in the Clery Act), dating violence, domestic violence, or stalking as defined in the Violence Against Women Act (VA WA).

This includes protections against:

 

  • Sexual harassment
  • Sexual assault
  • Dating and domestic violence
  • Stalking
  • Retaliation for reporting or participating in a Title IX investigation

Title IX applies to all students, staff, applicants, and visitors to the District, regardless of sex, gender identity, or sexual orientation.

Examples of potential Title IX violations:

1) Harassment or discrimination based on sex or gender identity or expression
2) Harassment or discrimination based on Pregnant or Parenting status
3) Bullying or harassment in the form of:

  • Comments, threats, gestures, or rumors of a sexual nature
  • Sharing/showing images/videos of a sexual nature
  • Non-consensual sex acts
  • Sex-based inequity in athletics

Who is Protected?

 

Anyone who is participating in or attempting to participate in a School District of Lancaster program, service, or activity including students, employees, volunteers, visitors, and third parties—may file a Title IX report if they believe they have been subjected to sexual harassment or sex-based discrimination.

The School District of Lancaster is committed to maintaining a safe, positive learning and working environment that is free from discrimination, including sexual harassment as defined by Title IX of the Education Amendments of 1972. In accordance with federal and state laws, as well as District Policies 103 and 104, we do not tolerate discrimination on the basis of race, color, age, religious creed, religion, sex, gender, gender identity, sexual orientation, ancestry, national origin, marital status, pregnancy or handicap/disability. in any of our programs, activities, or employment practices.

How to Report:

Reports can be made verbally or in writing at any time, including outside of school hours. Anyone may file a report on behalf of themselves or someone else. The reporting forms are located in Administrative Regulations listed as 103-AR-00 and 104-AR- 00.

Students:

If a student has been subject to conduct by any student, employee or third party that constitutes a violation of the District’s anti-harassment or nondiscrimination policy(s), the student or their parent/guardian, is encouraged to immediately report the incident in any of the following ways:

1) Complete the reporting form found in the corresponding Board Policy.

2) Email the Student Title IX Coordinator directly: TitleIX@sdlancaster.org 

3) Report the incident to the building principal or designee, or to any other member of the school staff.

Employees:

An employee or third party who believes they have been subject to conduct by any employee or third party​​ that constitutes a violation of the District’s anti-harassment or nondiscrimination policy(s) is encouraged to immediately report the incident in any of the following ways:

1) Report the incident to the building principal or the immediate supervisor

2) Complete the reporting form in Board Policy 104.

3) Email the Employee Title IX Coordinator directly: TitleIX@sdlancaster.org 

Mandatory Reporting:

Any employee who witnesses, suspects or is notified that a student has been subject to conduct that constitutes a Title IX violation shall immediately report the incident by using the reporting form from the corresponding Board Policy.

Sports Equity Issues:
Concerns or inquiries regarding sports equity should be directed to TitleIX@sdlancaster.org or a Title IX Coordinator.

What happens after a report is made?

  1. The Title IX Coordinator will promptly contact the complainant to:
    1. Explain the process
    2. Discuss supportive measures
    3. Offer the option to file a formal complaint
  2. The Title IX Coordinator will assess whether the concern:
    1. Falls under Title IX sexual harassment regulations
    2. Requires other district processes under Policy 103 or 104
  3. If a formal complaint is filed, a neutral investigation will begin. The District ensures due process for both the complainant and the respondent.

Supportive Measures

Regardless of whether a formal complaint is filed, the District will offer supportive, non-disciplinary measures to both parties, which may include:

  • Adjustments to class or work schedules
  • Counseling services
  • Safety planning
  • Increased monitoring or security
  • Contact limitations
